Copyright and copyright-related rights
- We provide advice and support in negotiating licensing agreements, including licenses to use copyrighted works, assignment agreements, franchise agreements and other copyright-related legal relationships. We handle specific legal issues relating to the regulation of legal relationships for work products created by employees, commissioned work, collective work, school work and competition work. We also draft and negotiate contractual documentation for the development, licensing and distribution of software solutions.
- We have extensive experience in the legal protection of architectural works. We specialize in legal issues that relate to the protection of original architectural projects, designs and building solutions, both for individual buildings and complex urban development projects. We provide support in the protection of rights to works in the phase of implementation, and subsequent use and changes to works. We ensure the protection of architectural works and the proper enforcement of copyright in the context of construction and development projects.
- We also provide advice on the legal framework for the exploitation of copyrighted work, including rights in audiovisual, musical, literary, visual and computer work. We focus on copyright, such as the protection of the rights of performers, producers and publishers, and have considerable experience in broadcasting law and in representing clients in proceedings before the Broadcasting Council.
Dispute resolution, including unfair competition and protection of trade names and business names
- We specialize in litigation involving the protection and enforcement of intellectual property and industrial rights, unfair competition, domain name disputes and interference with trade names, reputation and trade secrets.
- We have extensive experience in unfair competition litigation. We support clients at all stages of unfair competition disputes, from drafting notarial deeds on the status of the case (including websites), drafting and filing motions for interim measures and for increasing deposits for interim measures, and for defence against interim measures. We represent clients as plaintiffs, defendants or auxiliary parties at all levels of the court system, and pursue claims for damages that may result from interim measures. In many cases, we have been able to reach amicable settlements at various stages of litigation.
- Our strength is that we are also able to represent clients in disputes involving copyright infringement, including unauthorized use or distribution of work, piracy and software infringement. Based on a detailed analysis of the protected work and the infringing conduct, we suggest optimal steps for pursuing claims, including claims for damages or the release of unjust enrichment, and preventing further infringement.
- In cases that involve infringement of a trademark, trade name and other designations, we provide legal representation in enforcing rights and protecting corporate identity, including negotiating out-of-court settlements and filing lawsuits.
Trademarks
- We guide clients through the complete trademark registration process, from trademark search through drafting and filing applications to opposition resolution and representation in subsequent administrative court proceedings, including at the Supreme Administrative Court and the Constitutional Court. Our strengths include thorough knowledge of the procedures and our individual approach to the protection of the client's brand and rights.
- We represent clients before the Czech national Industrial Property Office (IPO) and the European Union Intellectual Property Office (EUIPO), and cooperate with reputable local law firms in other countries and in cases before foreign authorities.
Trade secret and know-how protection
- We specialize in identifying, protecting and enforcing rights to sensitive information that is not publicly available and has commercial value, such as key business information, technological innovations, internal processes, business strategies, know-how and other sensitive information, including trade secrets.
- We draft and review agreements that define the rules for protecting trade secrets between employees, business partners and suppliers, including non-disclosure agreements (NDAs), licensing agreements, and other legal instruments to protect corporate information and its disclosure or transfer.
- We advise on the development and implementation of internal policies and procedures aimed at protecting confidential information, including training employees and setting up technical and organizational measures to ensure the protection of trade secrets.
- We also focus on preventing and minimizing the risks associated with the leakage or unauthorized use, disclosure, or theft of key business information, technological innovations, internal processes, business strategies, know-how and other sensitive business information.
- In cases that involve trade secret infringement, we provide legal representation in the enforcement of relevant claims, both at the level of out-of-court settlements and in court proceedings. In the context of requests for information under information laws, we help obliged or affected parties identify and justify withholding information on the grounds of trade secret protection.
