Disputes
Dispute resolution is a key area of our practice. Our extensive experience includes representing clients in disputes in all areas of law as well as in business non-profit sectors. Thanks to many years of cooperation with respected foreign law firms, we are able to effectively represent clients in international disputes and arbitration and coordinate resolutions across jurisdictions. We always focus on promptly and accurately identifying the key elements of the dispute and assessing the merits of an amicable solution, and tailor our litigation strategy to the client's business interests and the pursuit of the best possible resolution. A number of court and arbitration decisions in favour of our clients have become landmark decisions in their respective areas of law and are cited in other subsequent case law and decision-making practice.
Litigation
- Advice on claims brought by or against clients, including assessing the validity of such claims.
- Representing clients in court proceedings, including proceedings on ordinary and extraordinary appeals (including complaints to the Constitutional Court of the Czech Republic and the ECHR), in particular in proceedings concerning disputes arising out of contractual relations, disputes for damages, corporate disputes,including disputes concerning the invalidity of resolutions of general meetings and the adequacy of remuneration, labour disputes, unfair competition disputes and disputes arising out of infringement of intellectual property rights
- Representing clients in damages lawsuits against the state for unlawful decisions or maladministration
Administrative justice
- Representing clients in reviews of decisions and other actions of administrative and financial authorities before administrative courts, including the Czech Supreme Administrative Court
- Representing clients in judicial reviews of administrative decisions concerning private law relations, including proceedings on ordinary appeals and extraordinary appeals before the Czech Supreme Court
- Representing clients in administrative proceedings and litigation arising from decisions of EU institutions
Arbitration
- Representing clients in ad hoc arbitration proceedings (in particular under UNCITRAL rules) and before permanent arbitration courts and institutions (in particular the Arbitration Court of the Czech Chamber of Commerce and the Arbitration Court of the Czech Republic, ICSID, ICC, VIAC, etc.)
- Some of our attorneys are arbitrators at the Arbitration Court attached to the Czech Business Chamber and the Czech Agrarian Chamber
