Representation before the Czech Competition Authority, EU Commission, and Czech and EU courts
- Representing clients in all types of proceedings before the Czech Competition Authority and the EU Commission, including representation in merger clearance proceedings for clients with significant market share, representing clients in proceedings concerning dominance and potentially anticompetitive agreements, including submission of leniency and settlement applications
- Representing clients in court proceedings before Czech and EU courts in reviewing administrative decisions issued in the field of competition
- Representing clients before civil courts in private law claims arising from breaches of competition rules, in particular in disputes for damages for distortion of competition by cartel conduct or abuse of dominance
Competition advice and competition compliance
- Advising clients on competition law, including assessing various commercial agreements for their compliance with competition rules
- Advising clients on the regulation of significant market power in the sale of food and agricultural products, including the assessment of contracts and agreements and their compliance with the rules on the regulation of significant market power
- Analyzing our clients' new and existing business models and helping them to achieve their business objectives in compliance with competition rules, in particular with regard to pricing policy,supplier and distributor relations, the establishment of functional distribution systems, information exchange and cooperation with business partners at the horizontal and vertical level
- Training for managers and employees on how to identify and minimize the risks associated with illegal horizontal and vertical agreements, information sharing and abuse of dominance
- We assess a client's market position and set rules to follow if the client is in a dominant position
- We help develop and implement in-house competition compliance programs, and conduct antitrust risk audits and in-house investigations. We tailor and conduct specific training on practical issues such as supplier, customer and competitor relations, including information exchange, distribution rules, industry organization activities and dawn raid procedures
