At KŠB we have extensive experience in advising contracting authorities and participants in public procurement procedures. Thanks to our unique connection to our contractual relations, public support and competition law practices, we are able to advise on a wide range of public procurement matters, particularly projects in the energy, transport, IT and healthcare sectors. Our team has also been involved in a number of projects with European and international significance, which reflects our detailed knowledge of EU law. Representing clients in audit investigations and inspections before the Office for the Protection of Competition and before administrative courts is also an indispensable part of our practice.
Assistance to public contracting authorities
- Full-service assistance to public contracting authorities in the preparation and administration of tendering procedures, including the selection of a tender procedure that will enable the contracting authority to obtain the best solution in the shortest possible time, in the best possible quality, and at a reasonable price.
- Preparing and organizing pre-market consultations in order to set the terms and conditions of the contract which best meet the needs of the contracting authority, which the contracting authority may not initially know or define.
- Dealing with objections from suppliers on the terms and conditions and on the steps taken by the contracting authority.
- Drafting legal opinions and analyses with overlap into other areas of law, including European competition law and public aid law.
- Proposing an appropriate model for tender evaluations so that the contracting authority always obtains the most advantageous offer in terms of quality and price, also in cooperation with renowned economic advisors.
Subsidized public procurement
- Drafting complete tender documentation taking into account the conditions of the subsidy, with emphasis on the specific needs of the contracting authority, including mapping and analysis of the relevantmarket.
- Assisting in the administration of the procurement procedure so that it is conducted in accordance with the grant rules.
- Drafting legal opinions and analyses relating not only to public procurement law but also to related issues of public aid and foreign subsidy law.
Sectoral public procurement
- Drafting complete tender documentation for sectoral public procurement, focusing on the specific activity of the sectoral contracting authority and its needs, which we always try to understand to the maximum extent possible and reflect in the requested solution.
- Assisting in the administration of the tendering procedure for sectoral public contracts, taking into account its specificities and different legal regulations.
- Drafting legal opinions and analyses reflecting our extensive know-how in the field of sectoral public procurement, including EU legislation and the case law of the Court of Justice of the European Union.
Assisting suppliers in the tendering process
- Assisting in the submission of requests to participate and tenders for tendering procedures, clarifying and supplementing them so that the supplier meets the tender conditions in all respects and submits the most advantageous tender which fully meets the contracting authority’s requirements.
- Analyzing the terms of reference from the supplier’s point of view and the adequacy of the required performance so that the supplier can also qualify for the tender procedure, if the procedure is legitimate.
- Drafting objections against the terms of a contract or against the contracting authority’s actions.
Representing clients before the Competition Authority and administrative courts
- Drafting individual submissions using extensive know-how in Czech and European law and experience in representation before Czech and European courts.
- Representing contracting authorities and suppliers in proceedings before the Competition Authority and in subsequent court proceedings.
- Preparing an appropriate procedural strategy
