KSB Helps Mattoni 1873 Win Employment Dispute and Arbitration Proceedings

KSB’s team (associates Barbora Musilová and Martin Štefko and partner Dagmar Dubecká) won an employment dispute before the Czech Supreme Court in which they represented Mattoni 1873 against a former employee who worked for the company as a sales representative.

The dispute over the validity of the employee’s immediate dismissal went as far as the Czech Supreme Court, which agreed with Mattoni 1873’s reasoning and confirmed that the employee’s actions actually did constitute grounds for immediate dismissal.

Another KSB team, consisting of Miloslav Petrů, Filip Buchta and Dagmar Dubecká, represented Mattoni 1873 in arbitration proceedings before the Arbitration Court of the Czech Chamber of Commerce and the Czech Agrarian Chamber, in which Mattoni sought payment for damages due to a business partner’s early termination of a sublease agreement. 

As a result of the breach, Mattoni was forced to enter into a new contract on substantially unfavourable price terms. The Arbitral Tribunal agreed with Mattoni’s reasoning (including its argument based on the new concept of damage under the Civil Code, namely that the damage in this case constituted a debt) and awarded Mattoni damages in full, together with statutory default interest.
